A Conditional Order is the stage in the divorce process where the Court confirms that is sees no legal reason why the divorce cannot proceed.
It is the legal term that replaced what was previously known as a decree nisi following the introduction of no-fault divorce in England and Wales on 6 April 2022.
Once a divorce application has been issued, there is a mandatory 20-week waiting period before an application can be made for a Conditional Order. This period is intended to give couples time to reflect and made practical arrangements relating to finances, property and childcare where necessary.
A Conditional Order does not legally end your marriage. It simply confirms that the Court is satisfied that the divorce can move forward.
After the Conditional Order has been granted, there is then a further minimum waiting period of 6 weeks and 1 day before an application can be made for the Final Order.
